When the Conservative Political Action Conference takes place on February 27, 2021, in Orlando, Florida, Kristi Noem will speak. CPAC, which started in 1974, is a meeting place for conservative groups, activists, and world leaders to talk about things that are important to them. Noem took a page from Texas this week when she proposed a bill based on a law that would ban most abortions in the state.

It’s not a surprise: Noem has been talking about this idea for a long time. If the law is passed, women would not be able to get an abortion after the foetal heartbeat starts, which is about six weeks. This is when many people don’t even know they’re pregnant.

It’s not just the ban itself that scares critics. It’s the way it works: It encourages anyone in the United States to sue those who help women get abortions, with a minimum $10,000 fine.

It’s very similar to a Texas law that caused a lot of controversies last year. A series of appeals courts ruled that the law should stay in place while the courts decide whether to overturn it. In the 1973 landmark case Roe v. Wade, a judge said that a woman had a constitutional right to abortion. The new law, on the other hand, creates a “vigilante” justice system that doesn’t follow that precedent.

During the last month, the conservative-majority Supreme Court sent the measure back to an appeals court. This one has already ruled in favour of the measure two times.

In South Dakota, at least, the bill comes at the end of a long fight to keep women from getting abortions. There is only one abortion clinic in the whole state. Only 10 women there had an abortion in 2020, according to CBS News, which used the most recent data.

In a statement, Noem called on the Supreme Court to overturn Roe v. Wade. “Until that happens, these bills will make sure that both unborn children and their mothers are safe.”
